Reverse mortgage loans and Home Equity Conversion Mortgages (“HECM(s)”) are not endorsed by the government and must be repaid with interest. All applicants for reverse mortgage loans and HECMs are required to take mandatory counseling from a HUD approved counselor. The loan must be paid in full (including property taxes and insurance payments) in order for the applicant’s family or other beneficiaries to inherit the property serving as collateral for the loan; any failure to satisfy those requirements can trigger a loan default that could result in a foreclosure. All applicants for reverse mortgage loans and HECMs are encouraged to discuss the loan with their family members or beneficiaries before a loan application is signed. Two additional factors are expressly prohibited when dealing with loans insured by the Federal Housing Administration (the “FHA”) and the properties providing security interests therefore. In 2012, the U.S. Department of Housing and Urban Development issued a rule that prohibits FHA-approved lenders from basing eligibility determinations for FHA-insured loans on actual or perceived sexual orientation or gender identity.
